Democrats Eye AI Regulation as a Competitive Advantage

As the midterm elections approach, Democrats are considering how to leverage AI regulations to regain a congressional edge.

With the upcoming midterm elections, Democrats see an opportunity to regain control of Congress and tackle the complex issue of artificial intelligence (AI). Polls indicate that they may flip at least one chamber, potentially leading to a shift in scrutiny towards AI companies.

New Opportunities for Oversight

If they secure a majority, key Democratic leaders have expressed a willingness to investigate AI-related issues, such as tax incentives for data centers and recent cybersecurity breaches. They would have the power to set committee agendas, summon CEOs to testify, and demand access to company documents to better understand the industry's inner workings.

The growing involvement of AI in campaign ads reflects its rising prominence, especially as local communities hold packed meetings to discuss data center developments. While former President Donald Trump has favored a hands-off approach to AI regulation, public sentiment reveals widespread concerns regarding the technology's implications for jobs, education, and everyday life.

Seizing the Opportunity

Democratic strategist Jesse Lehrich notes that the landscape for AI regulation is ripe for the taking. “The question remains whether Democrats can capitalize on this chance,” he states. Legislative discussions are still evolving, but several foundational issues—such as monitoring AI's development and addressing job displacement—have yet to gain significant bipartisan support.

Rob Flaherty, a former advisor in the Biden administration, mentions that many lawmakers were previously hesitant to engage with AI due to its complexity and the industry’s financial influence. However, as AI becomes increasingly relevant to voters, there is an opportunity for political leaders to resonate more effectively with the electorate.

Campaign Strategies and Public Sentiment

Flaherty, along with Karthik Ganapathy, has initiated a super PAC named Tomorrow Together, launching a $4 million advertising campaign that highlights Republican candidates' disconnection from AI issues such as online safety for children. They are focused not only on the current elections but also on shaping messaging for the 2028 presidential race.

The visibility of data centers, a prominent AI issue, has made it a focal point in many communities. However, polls show that blanket bans on state-level AI regulations, often advocated by Trump and some congressional Republicans, are broadly unpopular. Influential Democratic donor Ron Conway has even reconsidered his support for a pro-AI PAC after observing shifting voter attitudes.

Governors Taking a Stand

Some Democratic governors, including California’s Gavin Newsom and Pennsylvania’s Josh Shapiro, are beginning to adopt more assertive stances on AI. Newsom has launched an executive order aimed at creating an AI “kill switch,” while Shapiro has altered his approach to data centers amidst growing public pushback.

This evolving landscape may benefit Democrats as Trump’s anti-regulation stance limits the Republican response to AI. Although a few GOP figures like Florida Governor Ron DeSantis have voiced skepticism about AI, the broader Republican narrative is constrained by Trump’s strong alignment with the tech industry.

The Future of AI Regulation

Potential regulatory measures could involve embedding independent researchers in AI labs, increasing safety checks, and holding tech companies accountable for their impact on society. Lawmakers may also need to address demands for AI companies to contribute to solutions for job losses and related challenges faced by citizens.

While AI is not currently the top issue motivating voters, Flaherty argues that it represents a broader narrative. “It’s a story about politicians prioritizing corporate profits over the welfare of everyday people,” he asserts. This framing resonates with many and aligns with prevailing frustrations in the electorate.

As the conversation around AI continues to evolve, the challenge will be for Democrats to engage thoroughly with these issues. Politicians must be willing to take significant measures that reflect the current moment’s demands to avoid falling behind. Voter attitudes show a readiness for bold action, rather than mere incremental changes like retraining programs.
